[Kundalini Yoga] Court Hearing Update - Feb. 18, 2010

 

Dear Members of Sadh Sangat, Sat Nam and blessings.
The following is an update from the court hearing yesterday. The judge
deferred ruling on the motion to disqualify SDI's counsel. She believed
the record before her was not clear that SDS had authority to remove any
SDI director and the judge acknowledged that S. Guru Amrit Kaur appeared
to have life time appointment. She asked the parties to file additional
briefs on this issue (Defendants by 2/25 and SDI by 7 days from
Defendants' brief or 3/4).

Unto Infinity also disclosed that in 2007 it had transferred ownership
of 90% of Golden Temple to a group of individuals including Kartar
Singh, Karam Singh, and a few others who formed Golden Temple
Management, LLC. UI retains only a 10% ownership interest in Golden
Temple. It was subsequently disclosed in a Golden Temple press release
this afternoon that Golden Temple is in the process of negotiating a
sale of the cereal business that will occur in the very near future.

The Judge allowed SDI to move forward with the discovery requested
concerning the proposed Golden Temple sale. Golden Temple produced some
documents this afternoon and will be deposed on Monday 2/22. The judge
also is requiring the defendants to produce further documents regarding
the 2007 restructuring of Golden Temple and for attorney Roy
Lambert to give a deposition on 2/23 or 2/24.

On 2/25 the judge will hold a hearing on Plaintiffs' soon to be filed
motion seeking to enjoin (stop) the Golden Temple sale. The judge also
moved up the hearing on Defendants' motion to dismiss the entire case
from 4/2 to 3/12/10.
